Terms of Service – DaDesktop Public Cloud

Intended Use

The remote desktops provided are meant solely for conducting training sessions, consulting engagements, or recruitment activities.

Prohibited Uses

The following activities are strictly forbidden:

1. Hosting websites or other services
2. Bitcoin mining
3. Carrying out performance testing

If DaDesktop personnel discover any of these activities, the service will be immediately discontinued with no refund provided.

 

Service Level Guarantee

DaDesktop ensures 95% uptime for the service.

All maintenance, repairs, and upgrades will be carried out outside of hosted working hours, which are 8 am to 8 pm local time (based on the server’s physical location in China).

 

Data Security and Confidentiality

The service is provided on an as-is basis; DaDesktop does not warrant the safety or confidentiality of any data transferred to the desktops. If you require such assurances, you should consider using DaDesktop On-Premise instead.

Since these desktops are primarily intended for training purposes, they are not appropriate for handling highly confidential information.

Authentication to the remote desktops is built for ease of access, not for high security.

Troubleshooting Recordings

Desktops used for courses—including fresh-start, trainer, and participant instances—may be recorded to assist with troubleshooting.

DaDesktop DELIVERS THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. NEITHER WE NOR OUR SUPPLIERS MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, SATISFACTORY QUALITY, ACCURACY, FITNESS FOR A PARTICULAR USE, AND NON-INFRINGEMENT. WE AND OUR SUPPLIERS DO NOT PROMISE THAT RESULTS OBTAINED FROM USING THE SERVICES WILL BE EFFECTIVE, RELIABLE, ACCURATE, OR MEET YOUR NEEDS. WE DO NOT GUARANTEE UNINTERRUPTED OR LOCATION-SPECIFIC ACCESS TO THE SERVICES, WHETHER DIRECTLY OR VIA THIRD-PARTY NETWORKS. ANY ORAL OR WRITTEN STATEMENT FROM A DaDesktop REPRESENTATIVE DOES NOT CREATE A WARRANTY. YOU MAY POSSESS ADDITIONAL CONSUMER RIGHTS UNDER LOCAL LAWS THAT THIS AGREEMENT DOES NOT OVERRIDE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

YOUR ONLY REMEDY FOR ANY DISPUTE WITH US OR OUR SUPPLIERS IS THE TERMINATION OF YOUR ACCOUNT. UNDER NO CIRCUMSTANCES WILL THE COMBINED LIABILITY OF DADESKTOP, ITS AFFILIATES, AND SUPPLIERS TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE TOTAL FEES YOU PAID DURING THE PERIOD IN WHICH THE CLAIMS AROSE. NEITHER WE, OUR AFFILIATES, NOR OUR SUPPLIERS SHALL BE HELD RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES STEMMING FROM YOUR USE OR INABILITY TO USE THE SERVICES.
